Ideas: An Organized Micke Desk
27 Jan 2012 | 6:31 amMaterials: Almhult cutlery tray Description: I bought a micke desk (width 55 7/8; depth 19 5/8; height 29 1/2). However, the drawers became cluttered. While walking through Ikea to get some inspiration and pick up a few items I found the Almhult cutlery tray ($2.99). I pick up two of these and trace my steps back to the work station exhibit to find a Micke desk to see if these trays would fit, and they did with space at the side. As you can see from my photo they are five compartments that allow you to store all your needs to have an effective work station. ~ Liza, New York

No Copyright Coverage of Digital Images of Useful Items (Furniture)
12 Jan 2012 | 10:30 amCopyright covers original, non-useful works of authorship; including pictoral, sculptural and graphic works, fixed in a tangible medium of expression. So shouldn't a digital image of a useful item, say high-end designer furniture, be afforded copyright protection? A digitially created image is really no different than a photograph and photographs of useful items have long been afforded copyright protection. Unfortunately, the plaintiff in a December 22, 2011 decision from the United States Disrict Court for the Southern… -
Don't Forget The Unfair and Deceptive Trade Practices Claim
10 Jan 2012 | 10:25 amIn a straight forward copyright infringement case the plaintiff cannot usually also assert a claim under North Carolina Gen. Stat. 75-1.1 because the claim is preempted by federal copyright law. See, e.g., Iconbazaar, L.L.C. v. Am. Online, Inc., 308 F. Supp. 2d 630, 636-37 (M.D.N.C. 2004); Vogel v. Wolters Kluwer Health, Inc., 630 F. Supp. 2d 585, 593 (M.D.N.C. 2008). For a state unfair competition claim to survive, it must usually be based on conduct not related to the allegations of copyright infringement, for example, fraud. However, when the tables are turned and the… -
When Is A DJ Action Appropriate For Trademark Infringement?
9 Jan 2012 | 3:43 pmMany are familiar with a declaratory judgment action in the context of patent infringement. The typical scenario involves demand letters from a patentee and the desire of another person or company to develop, market, and sell a product that is the subject of those letters. This often results in a declaratory judgment or "DJ" action filed by the recipient of the letters seeking an order that the accused product does not infringe the asserted patent. The action may also seek an order that the patent asserted is invalid and unenforceable. The same scenario can unfold with… -

Serta Challenges Oleg Cassini's Right To "Cassini" Name
29 Nov 2011 | 9:22 amOn November 10, 2011, Serta, Inc. filed a declaratory judgment action in the United States District Court for the Northern District of Illinois seeking to clear its use of the "Cassini" moniker on its line of Perfect Day mattresses. The Mattress Quality Myth, Do You Have To Buy a Known Brand?
18 Jan 2012 | 10:17 amThe baby has little to do with this post, I just love the picture! 20 years of experience in the bedding industry has lead to a startling conclusion. The well known national brands make many comfortable mattresses but they are not the most reliable. I would say that warranty calls on the lesser known brands have been out numbered by those from the big brands about 10 to 1. In other words the quality local brands I have chosen to display at Nine Clouds beds have been ten times less likely to have a problem as the big guys. This seems counter intuitive particularly because… -

Fibromyalgia and Sleep: an Adjustable Bed Can Help
29 Nov 2011 | 4:40 pmSleep hygiene & Fibromyalgia Sleep is in itself a period of active rehabilitation, not an empty gap between periods of activity. Most persons with fibromyalgia are distressed by inefficient or insufficient sleep, such that non-restorative sleep has become a hallmark of the condition. The physician (preferably a sleep specialist) should take some considerable trouble with such patients to enquire into their sleeping habits. These should include the nature of the mattress ( latex mattresses, memory foam mattresses and fully adjustable beds are good choices), the persons with whom their…

How The Bambach Saddle Seat Enhances The Flexibility Of A Height Adjustable Desk
26 Jan 2012 | 10:34 amBambach Saddle SeatA specialist chair like the Bambach saddle seat is an ideal match for height adjustable desk users. Whilst it is still possible to use an ordinary office chair with a sit to stand desk it is fairly limiting. What you will find is that you’re restricted to using it with your desk top set at pretty much the same height as a standard fixed height workstation, or maybe an inch or two higher. However once you go much beyond that standard chairs start to show their limitations and that’s where a seat like the Bambach comes into its own. Why is the Bambach good for… -
Why Height Adjustable Desks And Bar Stools Don’t Go Together
19 Jan 2012 | 9:18 amI was at a friend’s house recently admiring a new kitchen fit out and when I saw their funky new bar stools I thought what a cool idea for seating for height adjustable desks. It was only when I got the chance to sit in one that I realized my brainwave wouldn’t work in practice. Why it seems that a bar stool would work with a height adjustable desk On the face of it it looks like a great idea. The kind of bar stool I’m thinking of is the sort with a height adjustable gas lift. Fixed height ones would definitely be too inflexible. However with the adjustable height models… -
